损益比较原则下的国家安全和公民自由权——基于棱镜门事件的考察The PRISM Scandal,National Security and Civil Liberties

摘要(Abstract)：
美国的棱镜门事件涉及两个根本问题:一是美国政府以保护国家安全为名,对国内外民众的网络活动进行监控,是否侵害了民众的隐私权?二是斯诺登将绝密的棱镜计划泄露给外界,此行为是否属于言论自由的保护范畴?这反映了典型的国家安全和隐私权、言论自由等公民自由权的冲突。本文通过对美国相关法律和判例的分析,认为在处理安全和自由的冲突时,法院可采取损益比较的原则:如果增加安全的益处超过减少自由所带来的坏处,那么包括隐私权、言论自由在内的公民自由权就应受到限制,反之则不可。
